General Terms and Conditions

By clicking "Bestellen"/“Order“ I declare that I agree with the terms of participation and have read the privacy policy. I also agree that ARRtist may share my information with the event co-hosts and partners of the event with whom I have interacted at the event.

1. Scope of application

The following General Terms and Conditions ("T&Cs") apply to all ticket sales made by 030 Knowledge & Networking GmbH, Stedingerweg 16, 10407 Berlin ("Organizer") in the context of the ARRtist Events ("Conference") to its visitors.

The Conference will be held as a 3G, 2G or 2G+ event.

2. Ticket Ordering / Masterclasses / Roundtable Assignment

Tickets can be ordered - subject to availability - for the Conference as well as any other events of the Organizer via the Internet. Upon receipt of a corresponding registration by the organizer, a legally binding contract is concluded between the visitor and the organizer. The respective ticket price indicated is due immediately and the means of payment indicated by the visitor will be debited immediately after the ordering process. The contract is concluded in German. The GTC can be called up again by the visitor at any time at https://www.arrtist.net/conditions. The ticket service provider acts as an intermediary for the ticket order and in this respect any general terms and conditions of the ticket service provider apply in addition. The contract for the purchase of tickets is concluded directly between the organizer and the visitor.

However, special formats at the conference, such as master classes and roundtables, require a separate application. In this respect, the organizer will make a selection from all applicants together with the respective person responsible for the content of the special format ("speaker"). For this purpose, the organizer will provide the speaker with the first and last name, company, country and position of the applicants. The selected applicants will be notified separately by the organizer. There is no right to admission to a special format. Of the selected participants of a special format, the first name, last name, email address, company, country, career level, sector, company size, company type and position will be transmitted to the organizing company in order to enable a further exchange afterwards.

3. Return of tickets/ Cancellation and rescheduling of the event/ Note on the right of cancellation

Purchased tickets are excluded from return and exchange. Cancellations by participants or by the organizer cannot be made. This also applies in case of illness, non-participation or other reasons. A return of tickets is only possible in case of cancellation or an unreasonable rescheduling of the respective event. A rescheduling is considered unreasonable if the new date or venue is unreasonable for the visitor, taking into account his legitimate interests. However, this does not apply if the cancellation or rescheduling is due to force majeure (see paragraph 5).

The organizer will immediately announce a cancellation or postponement of the respective event on its website. In the event of a cancellation or unreasonable postponement, the organizer will refund the ticket price. Exhibitor, speaker and topic announcements are non-binding and may be changed by the organizer at any time.

Pursuant to § 312g para. 1, para. 2 no. 9 BGB (German Civil Code), the visitor has no statutory right of revocation, even if he orders tickets as a consumer rather than as an entrepreneur.

4. Transfer and expiry of tickets

Tickets are personal and generally non-transferable. If tickets are not filled out completely (name, first name, e-mail address) within the specified period, they will expire and no longer entitle the holder to admission.

5. Force majeure

If the respective event does not take place or is postponed due to circumstances beyond the organizer's control, such as force majeure and events of equal importance, e.g. national mourning, weather conditions, strike or war, the organizer shall not be held responsible for any loss or damage resulting therefrom. In this case, the ticket will not be refunded. In particular, a claim for reimbursement of travel and accommodation costs as well as loss of work is excluded. 

6. Admission to the event

The stay at and in the event location is at the visitor's own risk. The visitor must present a valid ticket at the admission control without being asked. Since the tickets are personal, he may also be asked to show a valid official identification document. If the visitor is granted admission, he or she will receive a non-transferable badge (e.g. an Event Badge or Wrist Band), which he or she must carry with him or her during the respective event, in particular in order to be allowed back in after leaving the event premises.

Each ticket holder irrevocably consents for all present and future media to the free use of his/her image and voice for photographs and/or recordings of image and/or sound made by the event organizer or its agents in connection with the event.
In the interest of safety and an orderly and smooth running of the event, the ticket holder is in particular obliged to follow the instructions of the police, the organizer, the security staff and the administration of the venue.

The implementation of advertising measures (e.g. promotions) or other measures that go beyond mere congress participation is only permitted with the prior consent of the organizer.

The making of picture/film and sound recordings is expressly prohibited.

The bringing of fireworks, bottles, cans, intoxicants, weapons, dangerous objects and pets is strictly prohibited. Obviously intoxicated participants forfeit their right to enter the venue.

In order to ensure a safe and pleasant event for all visitors, the organizer reserves the right to refuse entry to visitors who appear aggressive or abusive or who are under the influence of intoxicants.

7. Domiciliary rights and house rules

The organizer exercises the domiciliary rights at the events. His instructions are to be obeyed. The respective house rules of the event location are to be observed during the stay in the event rooms. In the event of violations of the house rules, the visitor may be excluded from further participation in the event and asked to leave the event premises. Further claims of the organizer against the visitor remain unaffected.

8. General limitation of liability of the organizer

The organizer is liable without limitation for damages caused intentionally or by gross negligence as well as for damages resulting from injury to life, body or health. The same shall apply in the event of a breach of any warranty promises or fraudulently concealed defects.

Furthermore, the organizer shall not be liable for damage to property or financial loss caused by slight negligence. This shall not apply in the event of a breach of an obligation which makes the proper performance of the contract possible in the first place and on the observance of which the visitor can regularly rely; in this case, the liability of the organizer for property damage or financial loss caused by slight negligence shall be limited to the foreseeable damage typical for the contract.
Any liability under the Product Liability Act remains unaffected.

The aforementioned limitation of liability shall also apply to the personal liability of the organizer's vicarious agents and employees.

9. Special limitation of liability for the checkroom

If the organizer offers to store items, e.g. coats, jackets, suitcases or bags, for the visitor at an event free of charge ("checkroom"), the following conditions apply:

The visitor may not leave any valuables (e.g. laptops, smartphones, jewelry), data carriers with confidential and/or business information, means of payment/cards or travel tickets at the checkroom;

the organizer is liable for property damage and financial loss due to damage or loss of the items only in the case of intentional or grossly negligent acts of one of its organs and/or vicarious agents and/or persons employed in the performance of its obligations.
The liability is limited to a maximum of 500 Euro per visitor.

10. Rights of use

By posting texts and other content (together "content"), the visitor or speaker grants the organizer the exclusive, spatially and temporally unrestricted right to reproduce, store, publish and/or make publicly available the content, including for advertising purposes, and to use it in all audio-visual media, in particular at www.ARRtist.net, on social networks or mobile offerings (apps) of the organizer or via the online offering of the organizer's cooperation partners. This includes the right to transfer or sublicense the content to third parties.

The organizer assumes no responsibility for the content. The content is the sole responsibility of the visitors or partners who create it; the organizer does not check the orderliness and legality of the content. In this respect, the organizer merely provides storage space.
Visitors or speakers assure that they have the necessary rights to place content in the organizer's offer. As a rule, you only have the necessary rights if you have created the content in question yourself or have received permission from third parties to publish it. The visitor or speaker fully indemnifies the organizer from any claims of third parties due to the violation of the rights assurance (including reasonable legal costs).

11. Data Protection

The organizer processes and uses personal data of the visitor only for the purpose of processing the ticket order and the event. In the event of an application for a special format during the event, the first name, last name, company and position of the applicant will be transmitted to the respective speaker of the special format for the purpose of selection. Everything else can be found in our privacy policy.

If and insofar as the visitor has consented, the data provided by the visitor may also be used for advertising purposes by the organizer or transmitted to third parties (such as partners). The visitor can revoke his consent to the organizer at any time (e.g. by sending an e-mail to the contact address given on www.ARRtist.net).

12. Other regulations

The exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Berlin, provided that the visitor is a merchant.

The law of the Federal Republic of Germany shall apply with the exception of the UN Convention on Contracts for the International Sale of Goods. Consumers with habitual residence outside the Federal Republic of Germany may also invoke the law of the state in which they have their residence.
